Debias Platform Terms and Conditions

Last updated: 12.10.2026

1. Scope and provider

1.1 These Terms and Conditions (the "Platform Terms") apply to all contracts for the use of the platform app.debiaslab.com (the "Platform") and the services offered on it between Dr. Nina Weber, Einzelunternehmen, trading as Debias, Lepsiusstr. 14, 12163 Berlin, Germany ("Debias", "we", "us") and our customers ("you").

1.2 Our services are offered to consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession when entering into the contract (§ 14 BGB). Provisions that apply only to consumers or only to businesses are marked as such.

1.3 Deviating terms of businesses only apply if we have expressly agreed to them in writing.

1.4 Mere use of our website debiaslab.com is governed by our Website Terms and Conditions. How we process personal data is described in our privacy policy.

2. Services

2.1 Studies. We survey people from the target audience you select about the content you provide (e.g. landing pages, website sections, flows, ads, product ideas), or about the target audience itself. We create the questionnaire based on validated research methods, recruit participants through an external panel provider, analyse the answers and provide the results to you on the Platform.

2.2 Analyser. The Analyser automatically checks a landing page against a psychological profile of the target audience, based either on your study data or on benchmark profiles, and shows recommendations on what you can change. An Analyser scan runs immediately after it is started.

2.3 The exact scope of an order results from the order summary shown to you before you complete the order (in particular test type, content, target audience criteria, number of participants, survey length and price).

2.4 We owe the professional performance of the ordered service, not any particular content of the answers or any particular business outcome. Study results reflect the views of the people surveyed. Analyser recommendations are based on scientific evidence and statistical models; we cannot guarantee that implementing them will lead to better results in any individual case.

2.5 Examples and example results on the website and in demo areas of the Platform are based on demo data.

3. Account and workspace

3.1 An account is required to use the Platform. You can register with an email address and password or with your Google account. Registration is free of charge. You must be at least 18 years old.

3.2 The information you provide during registration and in your billing details must be true and complete. Keep your login details secret and inform us without delay if you suspect misuse of your account.

3.3 Studies, scans and credits belong to a workspace. The owner of a workspace can invite other people. Invited members can view studies, run scans and export data. Whoever invites others is responsible for ensuring that these people use the Platform in accordance with these Platform Terms.

4. Conclusion of contract

4.1 The presentation of services on the website and on the Platform does not constitute a binding offer.

4.2 Ordering a study: You set up a study in several steps (test type, goals and questions, content, target audience and number of participants). Before completing the order, you see a summary with all essential details and the total price. Until then, you can correct your entries at any time using the back function or within the individual steps; drafts are saved automatically and are not binding. By clicking the "Pay now" button, you submit a binding offer.

4.3 Ordering Analyser scans: You choose a single scan or a bundle of several scans (credits). By clicking the "Pay now" button, you submit a binding offer.

4.4 The contract is concluded when we confirm your order by email or begin performing the service, whichever occurs first.

4.5 The contract language is English. We store the contract text. You can view the details of your order in your account at any time. You receive these Platform Terms in text form with the order confirmation.

5. Prices and payment

5.1 The prices shown on the Platform at the time of ordering apply. All prices are final prices and include statutory VAT.

5.2 The price of a study is calculated from the number of participants, the survey length in minutes and the per-minute price per participant. The total price is shown to you before you order.

5.3 The price is due upon ordering. Payment is processed by our payment provider Stripe using the payment methods offered on the Platform (e.g. credit card, SEPA direct debit, Apple Pay, Link). A study only starts after successful payment.

5.4 You receive an invoice by email after each payment. Invoices are also available for download in your account.

5.5 Refunds are made via the original payment method.

6. Performance of studies

6.1 Data collection for a study (field period) lasts no more than 5 days from the start. We may end the field period earlier once the ordered number of participants has been reached.

6.2 If fewer participants than ordered are collected within the field period, we refund the price for the missing participants pro rata. The refund is made within 14 days after the end of the field period.

6.3 We filter out answers from bots and answers that were given too quickly. Participants whose answers we exclude for this reason do not count towards the number of participants reached.

6.4 Once a study has started, it can no longer be cancelled, because from that point on we incur costs for the participants. The statutory right of withdrawal for consumers remains unaffected (section 11).

6.5 Incorrect performance. If we run a different study than the one ordered, i.e. with a different test type, different content or a different target audience than stated in the order summary, we will, at our discretion, run the study again free of charge or refund the price. It is not incorrect performance if you do not like the content of the participants' answers, or if participants meet the ordered target audience criteria but, in your view, do not fit your target audience.

6.6 Businesses must notify us of incorrect performance within 14 days after the results are made available. Consumers have their statutory rights.

7. Analyser and credits

7.1 Purchased credits never expire. One credit entitles you to one Analyser scan.

7.2 Unused credits are not refunded and cannot be paid out. The statutory right of withdrawal for consumers remains unaffected (section 11).

7.3 If we permanently discontinue the Analyser, we refund unused credits pro rata.

8. Your content and obligations

8.1 You ensure that you are entitled to use the content you upload or provide (e.g. screenshots, URLs, images, texts, product descriptions) for the study or scan and to grant us the rights set out in section 9.

8.2 Your content must not violate applicable law or third-party rights. In particular, content that glorifies violence, is pornographic, discriminatory, harmful to minors or incites hatred, calls for criminal acts, or deceives or harms participants is not permitted.

8.3 Your content should not contain personal data of third parties that is not necessary for the study (e.g. real customer data in screenshots). If personal data cannot be avoided, contact us before ordering.

8.4 If content violates this section, we may refuse or interrupt the study or scan. If no data has been collected yet, we refund the price.

9. Rights to content and results

9.1 Your content remains your property. You grant us the non-exclusive, royalty-free right to store, reproduce, show to participants and analyse your content to the extent necessary to perform the study or scan.

9.2 Your results. You may use, edit and publish the results of your studies and scans for any purpose, without restriction in time or territory.

9.3 Anonymised use by Debias. In addition, you grant us the royalty-free, irrevocable right, unrestricted in time and territory, to use your content, the study data and the results in anonymised form in order to:

  • create benchmarks and reference values,
  • develop, train and improve the Analyser and other Debias models and methods,
  • create and publish aggregated analyses, reports and studies.

Anonymised means that publications allow no conclusions about you, your company, your brand or your specific content, nor about individual participants. We only publish your content itself (e.g. screenshots of your landing page) with your prior consent.

9.4 All rights to the Platform, our questionnaires, methods, analyses and the Analyser remain with Debias.

10. Confidentiality

10.1 We treat your content and results confidentially and only share them to the extent necessary to perform the service or as permitted under section 9.3.

10.2 Your content is shown to the participants of a study. We ask participants to keep the content confidential, but we cannot rule out that individual participants fail to do so. Do not upload content whose disclosure would be unacceptable to you.

11. Right of withdrawal for consumers

11.1 Consumers have a statutory right of withdrawal. The details are set out in the withdrawal policy in Annex 1. You can also declare withdrawal using the "Withdraw from contract" button in your account. Businesses have no right of withdrawal.

11.2 For studies, the right of withdrawal expires once we have fully performed the study, provided that before ordering you expressly agreed that we begin before the end of the withdrawal period and confirmed your knowledge that your right of withdrawal expires upon full performance of the contract. If you withdraw after the start but before full performance, you owe compensation for the services provided up to that point.

11.3 For Analyser scans, the right of withdrawal expires when execution begins, provided that you expressly agreed that we begin execution before the end of the withdrawal period, confirmed your knowledge that you thereby lose your right of withdrawal, and we have confirmed the contract to you on a durable medium. For unused credits from a bundle, the right of withdrawal remains within the withdrawal period.

12. Liability

12.1 Towards consumers, we are liable in accordance with the statutory provisions.

12.2 Towards businesses, the following applies:

  • We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the Produkthaftungsgesetz (German Product Liability Act) and to the extent of any guarantee given.
  • In cases of simple negligence, we are only liable for breach of essential contractual obligations, i.e. obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment you may regularly rely. In this case, liability is limited to typical, foreseeable damage, and in any case to the price of the affected order.
  • Otherwise, liability for simple negligence is excluded. This applies in particular to lost profits and to damage resulting from decisions you make based on study results or Analyser recommendations.

12.3 These limitations of liability also apply in favour of our vicarious agents.

13. Platform availability

We aim for high availability of the Platform but cannot guarantee uninterrupted availability. Where possible, we carry out maintenance so that running studies are not affected. Running studies are not cancelled due to Platform outages.

14. Term, deletion and suspension of the account

14.1 The account runs for an indefinite period. You can request deletion of your account at any time by email to contact@debiaslab.com. Studies that have already started will be completed. Unused credits lapse upon deletion; we will point this out to you before deletion.

14.2 We may temporarily suspend or terminate your account if you breach these Platform Terms, in particular in the case of prohibited content under section 8.2, false information or misuse. In doing so, we take your legitimate interests into account and inform you in text form. Our right to terminate the account with 4 weeks' notice remains unaffected; in that case, we refund unused credits.

15. Changes to these Platform Terms

Changes to these Platform Terms apply to orders placed after the change. We inform you by email at least 4 weeks before changes affecting your existing account take effect. If you do not object within this period, the changes are deemed accepted; we will point out this consequence in the notification. If you object, we may terminate the account with 4 weeks' notice and refund unused credits.

16. Data protection

How we process personal data in connection with the Platform is described in our privacy policy. How we process participants' data is described in the privacy notice for participants.

17. Final provisions

17.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.

17.2 If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin.

17.3 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17.4 These Platform Terms are provided in English.

17.5 If any provision of these Platform Terms is invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provisions.

Annex 1: Withdrawal policy (for consumers)

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Dr. Nina Weber, Debias, Lepsiusstr. 14, 12163 Berlin, Germany, phone: +49 152 27163771, email: contact@debiaslab.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at app.debiaslab.com using the "Withdraw from contract" button in your account. If you use this online function, we will send you an acknowledgement of receipt without delay on a durable medium (e.g. by email), including information on the content of the withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Notes on early expiry of the right of withdrawal

For contracts for services (studies), the right of withdrawal expires once we have fully performed the service, provided that before ordering you expressly agreed that we begin performance before the end of the withdrawal period and confirmed your knowledge that your right of withdrawal expires upon full performance of the contract by us.

For contracts for digital content not supplied on a tangible medium (Analyser scans), the right of withdrawal expires once we have begun performance of the contract, after you have expressly agreed that we begin performance before the end of the withdrawal period, confirmed your knowledge that by giving your consent you lose your right of withdrawal once performance begins, and we have provided you with a confirmation of the contract on a durable medium.
